Late yesterday, the Office of Management and Budget (OMB) and the Office of Personnel Management (OPM) provided further guidance to the heads of executive departments and agencies regarding the federal civilian hiring freeze. It says they should use the same criteria for exempting positions from the hiring freeze as they use when exempting positions from furloughs during an interruption in appropriations, frequently referred to as an emergency shutdown furlough.
Over the past few years, NATCA has worked with the FAA to refine its list of excepted positions in accordance with a 1981 OMB memo called “Agency Operations in the Absence of Appropriations.” That memo is referenced in yesterday’s joint OMB/OPM memo (please see attached) and is used to determine which positions should not be furloughed because they are essential activities to the extent they protect life and property in accordance with the
Antideficency Act.
Yesterday’s joint memorandum lays out the process by which agencies may except positions from the hiring freeze. We believe the FAA has prepared, and will be submitting, its list of exempt positions soon.
As we advised
in our last update, OMB clarified that internal reallocation of employees to meet the agency’s highest priority needs are not affected by the hiring freeze. To that end, FAA Human Resources has advised NATCA that employee transfers, (e.g. ERRs, NEST placements, and hardships) are not affected by the hiring freeze.
