I would like to get some input on if I actually have a case for a hardship.

I am married but my wife does not live with me currently. She actually never moved when I was selected to go to the academy, due to her job and also staying close to her parents. This has been our situation for the past several years and it is definitely causing a strain on our relationship. It causing a hardship situation on both of us because its coming down to either my marriage or my job. Unless I can get a transfer.

Would this have a chance of being approved? What if we became legally separated? Also, we currently do not have any children but would like to, however due to the present situation everything has been kind of put on hold. What are my options here?
 
Yeah unfortunately, unless there are some extenuating circumstances (like medical/family medical reasons), her just not wanting to move isn’t a hardship. Otherwise every married person that goes to the academy could use that excuse.
 
So, has anyone ever heard of a circumstance where a hardship was accepted that was not due to a medical condition?
 
Lol I'm sure you're a nice guy but come on dude, you have to realize this is absurd. You should probably make sure your life partner is on board with moving anywhere before you take a job that you know ahead of time can make you move anywhere. This isn't some unforeseen circumstance.
 
Not only do I not feel bad, the more I think about shit like this the more irritated I get. If you DO find a way to hardship somewhere by attributing it to something else then you're one of the "scam" hardships that everyone complains about. You're totally willing to make it more difficult for someone that's done everything the right way to move legitimately. I couldn't care less if it's between your marriage and your job, how about don't take the job if you and your wife don't wanna move and then you won't have to put your wife in this position in the first place? Are you just fine with screwing over every single person in your life as long as you can have your cake and eat it too?

Dude, just read the contract. Article 99 Section 1. Medical condition of employee/spouse, care for a loved one with a medical condition where other arrangements aren’t possible, and dependent children. It’s pretty black and white.

No, a spouse wanting to live closer to her parents than her husband does not qualify as a hardship.
