JUST IN: Federal judge denies National Air Traffic Controllers Association request to pay workers during gov't shutdown, saying that only Congress can appropriate funds: “The Judiciary is not, and cannot be, just another source of leverage." - @CharlieGileNBC

At best it would create chaos and confusion,” Leon said. “At worst it could be catastrophic . . . I’m not going to put people’s lives at risk.”
Shutdown Lawsuits

Wouldn’t want to put people’s lives at risk, now would we?

Damn it. It’s about right vs wrong and they’ve denied us labor and constitutional rights. What a cowardly judge.

I was thinking the same thing. What a spineless approach to take. I'm not a lawyer but the judiciary isn't appropriating any funds by ordering an employer to pay employees for their work. What a crock of shit.

It was a ruling denying the TRO, not any of the lawsuits.
This is precisely what happened. look at 2013 gov shutdown, we have already won the FLSA case. This is not a final judgment. What he is saying is that he is not sending ATC, prison guards, TSA, or other safety critical personnel home. He is saying there are sever consequences if he were to make that ruling and he was not going to be the one to place peoples lives at risk over it.

Also even though the 2013 gov shutdown case was finalized in 2017 there have been no payouts so expect this case to be a while before you see anything from it.

My favorite part of this shutdown is that the House is supposed to be recessed starting January 17th (Thursday) and be out of session until January 28th.

So they recall everyone so everyone works while the government shuts down so nothing can be seen as “compromised” (aviation safety, food safety, etc.). Everyone works without pay. I hope everyone here is contacting their congresspeople. Now, everything can be in service except no one sees a paycheck. These politicians are lunatics.

Yeah, this is what worries me the most. Compared to the 2013 shutdown, this one feels like it has much less of a visible effect on most people. Obviously we feel the effects and know it's going on, but I have several friends and family who are only vaguely aware that there's a shutdown going on right now, simply because it doesn't have any noticeable effect on them. Things like delaying tax refunds to the entire country would have quickly brought the issue front-and-center to everyone, and the more they try to mitigate the effects by calling in more furloughed employees, the easier it'll be to let this stretch out indefinitely.
