Right when you decide to come back, the rest is dependent upon staffing

For all FMLA (including PPL now), intermittent leave is subject to your supervisor's approval.
I know there's ATMs out there that say "once you're back, you're back permanently."
That is not true (except for the people that tried to just use FMLA on just their 5/5 or 5/10 work days...that clearly is cheating and circumventing.)

There's an HRPM that talks all about it. Which apparently some in management have had trouble applying correctly.

Adding to what stinger said, nowhere is it stated the leave is subject to staffing and workload. There would need to be extenuating reasons on why a request to use PPL is denied.

Some people maybe confusing this with baby bonding Leave. That is guaranteed annual that must be taken all at once up to 12 weeks, but consecutive. After that you get the 12 weeks of PPL which does not have to be consecutive, and is also guaranteed.

Yes it is, unless they can’t make a medical accommodation under the ADA. In which case they’re required to put you on a leave of absence. Your front line supervisor cannot deny your FMLA leave, all they can do is say that they can’t reasonably accommodate you because the business impact of your accommodation is too great and you need to be put out on a leave of absence. Good luck making the argument that we aren’t able to perform the essential functions of our job or our productivity can’t be accomplished on a reduced schedule.

Baby bonding leave is from the contract. The thing is it MUST be consecutive. We had a guy looking into that to save 2 days of annual to get his COVID shot but agency said no dice, it has to all be together. The PPL is separate, excused absence, per the MOU.

According to this plus the natca MOU, the supervisor is only certifying that you are elegible ie you aren’t scamming the leave.

once they make that certification the 12 weeks falls under the same guidelines as FMLA annual which Shall be approved.

There are definitely some dirt bags who would try to scam baby leave.
