What a load of horseshit. We terminate people based on frequency loss expectations all the time. What service are you providing if you know from working the sector all the time that you’re going to lose comms and radar? Watching a coast track flash out there?
 
In its cross-complaint, attorneys for Island Express contend that Zobayan contacted the SoCal TRACON facility and requested "flight following,'' or radar assistance. The request, however, was denied by an air-traffic controller who said, "I'm going to lose radar and comms probably pretty shortly,'' according to the lawsuit.

Willing to bet that the FAA is going to settle on this case. They're not going to be dragged into a court battle with people that have millions of dollars to pursue this as long as it takes.

I just watched the Youtube clip. The controller told the pilot he was too low for flight following, which meant he was too low to be identified or to remain in radar contact for an extended period of time and receive radar services (VFR flight following). The pilot also informed VNY Tower that they were in VFR conditions after they had transitioned SVFR. The pilot was IFR qualified and equipped. If he was in weather difficulty he had every opportunity to ask for a local IFR clearance.

This is a pure cash grab by the helicopter company.

Or simply trying to deflect blame for the whole situation. They’ve been roasted in the media since day 1. Easy to point the finger at the government and hope it gets the reporters off your back.

It can't really be that surprising. Nobody wants to be at fault. Everyone sues everyone, the courts decide. The manufacturer will be sued, the faa, the company, etc

True. Like 32 referenced though, really sucks for the 2 guys that were on position that day. Not only did they have to deal with a loss of life incident, now they’ve gotta live in fear some sleazebag reporter is gonna leak their name and they’re gonna have to go into witness protection. That’s rough.

Would public threat from this qualify you for a hardship?

I mean if half of a city who doesn't understand the intracacies of a tragic accident that killed one of their most famous and loved local heroes think it was my fault thanks to a bullshit lawsuit and substandard reporting..... I may have half a mind to leave sunny socal for Iowa.

We’re both the controllers named from SCT? Miramar might as well be in another state in relation to LA.
