Damn that was my commute to Kennedy from Brooklyn but that was subway/AirTrain which fuckin sucked but at least I got to read to kill time instead of staring at a parking lot on the highway. I probably read 40 books in the last 3 years with all my commute time.

There are quite a few legal ramifications to be sure, and the trial will prove interesting. Not to go all Johnny Cochran on it, but he was about 20 miles from his home, under age (open carry is 18 no?), and certainly alone minus the “protestors.” That said the situation will garner much national attention in all legal aspects though I struggle, regardless of the laws Kyle broke (if found guilty) to sympathise with a convicted pedophile and wife beater.

Things are upside down and the devil is gaining stength. I have been going to church more and reflecting. We are in dark times. The prayer to St. Michael gives me strength and lifts me.

I would not be suprised if this ends up being a benchmark case for the 2nd amendment. He did not transfer that rifle across state lines, he took possession of it after he crossed supposedly, and if he was part of a militia (USC 10 states - The militia of the United States consists of all able-bodied males at least 17 years of age ) then that charge holds no ground. It has already been affirmed that you can practice your first and second amendments at the same time. So it really comes down to, was it self defense? Did he fear for his life? In the latter two its easy to say, a skateboard is a deadly weapon as is a handgun. Only time will tell how this one will fall out.

It is an excellent overview of the situation and how I interpreted it as well. Again as an arm chair lawyer (lol) trying to prove intent given the videos and available pieces of evidence will be very difficult to do. Most people, myself included in all honest probability, would react to being hit with a skateboard as carte blache to begin a rapid fire response on the target that attacked me until no movement was noted. If by accident or precision alone, his one round per person will not assist the prosecution in establishing intent.
