2025 Convention

The “benefits” of a 10+ year old contract? The “benefits” of some very shitty MOUs, the “benefits” of a Union whose hiding under its blankie because it puts a “target” on our back? I didn’t get a vote asking me if I wanted the Union to represent me. As a matter of fact, as a member, I’ve represented myself numerous times more than the local/region has/have/did.

I might be anonymous here - I’m anything but when I’ve tried to be part of the “fight”.
Should have shown up and spoke. Not hard to do. Oh wait.. nonmember?

I wonder what the eeoc will say. Maybe someone with a law degree can chime in. I think it's clear as day but we can try chatgpt too.

"The EEOC (Equal Employment Opportunity Commission) enforces the Age Discrimination in Employment Act (ADEA), which prohibits employers from discriminating against individuals who are 40 years of age and older. This means employers cannot treat older applicants or employees less favorably due to their age in any aspect of employment."
EEOC was dismantled by trump right ? 🤣

when does the amendment for age 56 waiver seniority rule go into effect? someone mentioned that you can only change seniority once per contract and apparently that was already done under the slate book......so if I understand the right we'd have to wait until after 2029??

Goes into effect in October. Slate book seniority has not been changed, but this will be the one change we can make under it.

So per that article Duffy thinks he already has the authority to extend the mandatory retirement age...
The Secretary does have that authority. It is clearly denoted at 5 USC 8425(a). And the President can also do it under 5 USC 8425(e). That said, exemptions from the mandatory retirement age can be given... but that doesn't mean one needs to accept an exemption. If you want to go when eligible, or when mandated, then go. I do not believe they can force you to stay if you want to retire and are eligible.

Federal Law: 5 U.S. Code § 8425 - Mandatory separation

(a) An air traffic controller who is otherwise eligible for immediate retirement under section 8412(e) shall be separated from the service on the last day of the month in which that air traffic controller becomes 56 years of age or completes 20 years of service if then over that age. The Secretary, under such regulations as the Secretary may prescribe, may exempt a controller having exceptional skills and experience as a controller from the automatic separation provisions of this subsection until that controller becomes 61 years of age. The Secretary shall notify the controller in writing of the date of separation at least 60 days before that date. Action to separate the controller is not effective, without the consent of the controller, until the last day of the month in which the 60-day notice expires. For purposes of this subsection, the term “air traffic controller” or “controller” has the meaning given to it under section 8401(35)(A).

..........

(e) The President, by Executive order, may exempt an employee (other than a member of the Capitol Police or Supreme Court Police) from automatic separation under this section if the President determines the public interest so requires.

..........

The regulation permitting this is clearly denoted at 5 CFR 842.806(b).

Federal Regulation: 5 Code of Federal Regulations § 842.806 Mandatory separation.

(b) Exemptions from mandatory separation are subject to the conditions set forth under 5 U.S.C. 8425. An exemption may be granted at the sole discretion of the head of the employing agency or by the President in accordance with 5 U.S.C. 8425(c). (Note: It says the President can do this under 8425(c), but that is now 8425(e) as noted above.)

The hardcore ND people argued against adding Pay and Benefits to what the union should strive for. They argued its implied. Took someone reading a few other unions constitutions that said pay and benefits including the Flight attendants Union who just spoke.

Was crazy hearing people argue against pay and benefits at a unions convention
That entire contingent from both ZLA and I believe BUR seemed to be against anything that would be seen as anti NDJH. Was absolutely wild seeing union delegates say we basically shouldn’t be asking for pay and benefits ever.

Many of the ZLA people are in with the NDJH crowd and on Details and Work Groups. Guess that’s more important than their members pay.

Oh I’m not saying anyone is going to be forced to stick around past 56, I just mean the handful that stay that will know NATCA attempted to strip them of seniority and might be disgruntled.

So I understand that they have the authority to grant individual exemptions. The specific The quote seems to indicate raising the minimums upon the entire workforce. If it was a scenario where individual controllers didn’t have to purposefully seek an extension but could just stay until 61 without any additional actions then the specific wording of the amendment that NATCA just passed wouldn’t really be applicable since individuals weren’t seeking an extension.

And I bet you believe reverse racism actually exists, moron
It was meant to be a joking tone.

Intellectually the racism definition would already include reverse racism. This administration just wanted to focus on helping the majority. Again there is a subtle sour amount of distaste in my writing but that doesn't change what was said.

Back to the topic at hand:

Did the agency play the biggest chess move and subvert the NATCA ammendment to strip seniority since no there is no waiver requirement to stay last 56?

I do not think so, I think this was intended from the beginning give the loss of "experience" and "able bodies." The thing to watch out here for, and I caution everyone on this but it is my take, is that once we cross that 56 line, Duffy or the administration is sure to use those that "volunteer" as examples to Congress that the 56 rule should go away.

Now "tin foil" hat time, Duffy has released his proposal for the new ATC system however we have NOT seen the GOP's proposal for one although we know it is being worked on. There have been a slew of articles the last few days from the Wall Street Journal pushing for a NAV Canada Model that (to me) have Paul's fingers all over it. Logically it would make sense for Duffy/GOP to reconcile the proposals to keep/remove things. That said the biggest factor coming up will probably be the FY26 budget, and that could throw a wrench into everything.

Tin foil hat? Tim Arel, Paul Rinaldi, NavCanada, and some other private people were all at an event together posting pictures on linkedin. Coincidentally head FAA execs are "leaving"

The 2013 privatization/consolidation is now rebranded as modernization.

We are fighting to get pay and benefits added as something to fight for....the rug pull is coming next.
