Introducing non-pertinent topics rather than addressing the actual issue is precisely the definition of whataboutism. i didn’t define what a riot is. I wouldn’t call occupying a highway a riot. Certainly disruptive but not a riot.

Burden of proof falls on the person who makes the claim.

... the judge does not then say it's the defense making *the claim* that it's a lie, and that they need to prove otherwise. Rather *the claim* is still that the defendant raped the victim.

In your example of a trial the defense would then go on to prove why the claim is a lie.

The defense can simply move for the judge to dismiss the case after the prosecution rests for failure to prove the defendant’s guilt beyond a reasonable doubt. The judge can do so without even giving the jury a chance to deliberate.
