Deviations

Ohhh sorry, I should have been more clear. I ment deviations as in moving from a controller position to another job (sup/tmu) when your facility doesn’t have the staffing to let you go
It's in reference to deviating from the National Release Policy (NRP).

From Section 12, C.
Extensions beyond the timeframes identified above or other deviations from the National Release Policy for facilities that do not meet the criteria for Category 1 or 2 require approval of the Office of the Chief Operating Officer (COO) of the Air Traffic Organization (ATO). Decisions of the COO office are not subject to review, however, the COO office will notify the Union at the National Level in advance of issuing the decision to the affected facility and/or employee.
 
Do they issue a TOL before filing for a deviation? To make sure the individual is still interested in taking the position?

No, they file a deviation and the selected candidate only finds out if the deviation is approved. If not, the job is rebid or they select another candidate who doesn’t require a deviation. There is no merit based promotion system in the FAA. They will hide behind “Agency need” until they get sued.
