Government Shutdown - March Edition

If there's a shutdown, how does leave work specifically for the following:

WED 12/25: Holiday Leave (RDOs something other than WED/THU)
THU 12/26: XTU Leave

Will it just be Furlough both days, then?
You cannot be on a form of paid leave while in furlough status. If you are not at work, it will be considered furlough without affecting pay or leave balances.

This is not accurate/automatic. You can't take leave that was approved prior to the shutdown because that leave automatically gets canceled. But you can request new leave for those same dates and that new leave request can be approved.

13 USC 1341(c)
(3) During a covered lapse in appropriations, each excepted employee who is required to perform work shall be entitled to use leave under chapter 63 of title 5, or any other applicable law governing the use of leave by the excepted employee, for which compensation shall be paid at the earliest date possible after the lapse in appropriations ends, regardless of scheduled pay dates.

You don't WANT that. You WANT to be in furlough status instead because then you still get back-paid (that's what (c)(2) says) but without burning any of your leave. I guess if it was holiday leave it doesn't matter either way, but you can at least save the XTU.

If there is no paid leave status and someone bangs in on Xmas, they will be shown on furlough, correct? When the government opens back up, will this same individual be backed paid the holiday pay since there is no holiday leave ?

IF there is no paid leave status then yeah, "bang"="furlough." But I don't believe it's correct that there's no paid leave status. That was true in past shutdowns but it is no longer true. I believe that if you request sick leave you'll be granted sick leave. So why would you do that (burn your own sick leave) instead of requesting to be furloughed.

That's for banging on a regular day. Banging on a holiday complicates this. Normally any leave granted on a holiday is automatically converted to excused absence (holiday leave) even if it was approved as AL or SL. From the OPM document I referenced, question G.3:

What is the status of an “excepted” employee who does not perform work on a holiday
that occurs during a lapse in appropriations?

A.
An “excepted” employee who does not perform work on a holiday during a lapse must be
placed in a furlough status for the holiday and must be provided written notice of the
agency’s decision to furlough in accordance with the guidance in section P (Procedures).
This is because during a lapse in appropriations all affected employees must be (1) at work
performing excepted activities or (2) furloughed. This applies with respect to any period of
time that is part of an affected employee’s regularly scheduled administrative workweek,
including a holiday. (See Sample Notice of Furlough During Intermittent Absences and
Holidays to Excepted Employee.)
So as I understand it, if you bang on a holiday that does get converted to furlough, or at least it's supposed to. If you bang on a regular day it will not get converted, you'll be using your own sick leave balance.

Basically look out for #1 with all this stuff. Don't trust me or your MPA or NATCA or definitely not your FLM to know and understand what's happening. Make things as unambiguous as you can.

Man this thread sure has taken a downturn with the other news of the day.

Interesting thing I parsed through from an email from Whitaker in my FAA email . Should this thing shut down, the FAA still has funding for operational staff until the end of Saturday the 21st. Furloughs would not start until Sunday the 22nd. I'd post a picture of it or share the text, but you know... Go check your FAA emails if you need to see for yourself.

Basically, I don't think banging in on Saturday would be free leave if the Gov does shutdown. Even if it doesn't, it's still very interesting.

I didn't realize our own union was another arm of management. Anti-raise and wants us to work till we die with 4 days (or 3 days now) off a month, and equipment that doesn't work. Then they are essentially putting us in our place and warning us there will be consequences and they won't back us.

NATCA is an embarrassment to all unions and Nick is the clown running the show 🤡
