Technically, it’s not a listserv from the union. Instead, they’ve obtained your email addresses from an undisclosed source and then input them into Constant Contact, an online marketing company.
The crux of the matter is that this practice goes against the election guidance issued by the Department of Labor, which prohibits giving any group an unfair advantage, such as scraping email addresses from the NATCA portal.
Since we’re not currently in an election period, the election committee, which handles these matters, cannot or will not take action. This includes the simple solution of granting equal access to the listserv for all those wishing to campaign before nominations are made and accepted, even though the listserv is technically inactive.
NATCA’s privacy policy also doesn’t align with this use of member email addresses, but they haven’t responded to my inquiries.
So, the significant question is: where did they obtain everyone’s email addresses, and how did they do it? Your facility representatives are not permitted to release your email addresses in this manner.
Today, I spoke with someone from the DC office of the FLRA, and they have directed me to contact someone at the DOL.
