This is my opinion

Furlough of Excepted Employees:

  • If an employee is performing "excepted" work (work critical to human safety, the protection of property, or other excepted activities), they cannot simply stop working because their duties are essential.
  • Supervisors can deny a furlough request for such employees because the work they are performing is deemed necessary to continue during the shutdown.
  • In exceptional cases where an excepted employee requests to use paid leave (under 31 U.S.C. 1341(c)(3)) or seeks furlough status, the supervisor has discretion to approve or deny the request, taking into account operational needs.
Meta reply to myself. If you happen to be medically disqualified you would not be performing excepted duties for instance and would not be allowed other duties (for instance admin)
 
Can't just bang bang

Sup can deny furlough request and make you use accrued leave.

But if you have the shits, hives or take OTC cold meds to down yourself. Can't be given admin duties during a shut down.
Designated excepted employees cannot be in a paid leave (annual or sick leave) status. They will be placed on a furlough status during their absence and there will be no charge to leave balances.

I read that as well but in the posted opm guidelines there's something in there about the ability for an excepted employee to request to use accrued leave.

This was a copy/paste directly from NATCA. That’s how it works for us.

I'm not sure NATCA is right about that. This OPM document says (see F.2 and F.2a on pages 10-11)
  • Previously approved leave is automatically canceled
  • ...but excepted employees are allowed to request paid leave
  • ...but they don't foresee excepted employees requesting paid leave, because they could just take furlough instead
and that directly contradicts a couple of things on the linked NATCA page.

Of course I'm a schmuck posting on the internet and NATCA has salaried lawyers whose job is to know things, but I'm not sure how many people are willing to trust NATCA these days.
