NEST TOL offer incorrect pay?

I am a D2 washout at a level 10 Z. I received my TOL for EUG a level 6 facility. The offer is for the top of the D2 pay band. At this facility according to pt65 and 123atc AG,D2,D3 are the development pay bands.

My two co workers both washed out here earlier this year also both at D2. They both selected BFI a level 6 facility. Both of their offers were for the top of the D3 pay band. According to pt65 and 123atc BFI also has Ag,D2,D3 as development pay bands.

Am I getting shafted here?
 
Washout. None of the 3 of us withdrew. The contract wording is a bit convoluted.
Have you brought it up to your rep or RVP? The fact there’s a discrepancy works in your favor. You need to see if you can get copies of the BFI guys TOLs.

Consult your rep first. If they say they can’t do anything then you might have to go to your RVP. Send an email to H.R., don’t call. Send it bc you now need a paper trail for everything . Ask why 2 people who washed at D2 got d3 bfi payband but you’re only getting D2 eug pay. Make them show their work. Attach all TOLs to that email as evidence in your favor.

I have contacted my rep and sent them all 3 TOL and they will be back in the office tomorrow. They said they will take it up with the ATM. I have until friday to respond to the TOL. I haven't confronted HR with the other TOLs of my co-workers until my rep gets back to me. This is frustrating.

If you hear nothing by say Thursday, you need to email H.R., copying your ATM and rep, saying you can’t sign the offer because you don’t think it was calculated correctly. This is where you show them the other TOLs and tell them that you want an equivalent offer to what your peers with the same qualifications and placement options got.

HR often blows. Many of them don’t gaf at all. You have to be willing to fight for yourself.

I am 100% willing to fight them on it. I just want to make sure I am fighting the correct fight here. Possibly online data about BFI is incorrect and they only have D3 pay? In which case I could see reasoning. Thanks for your help. I am going to compile more data.

Article 108 section 7 H (3) is what you’re looking for. Your base pay should be remain unchanged and you be granted pay retention. Makes no mention of anything about career levels

Pay Retention means that it shouldn’t even matter, if your base pay is in the band you keep it.

Quote that article to HR as well

But he’s in the d2 band isn’t he?

This is the part that confuses me - HR quoted me this (image attached) when they came back with clarification on the TOL. My basic pay now exceeds the D2 band at EUG, exceeds their D3 band as well but i expected to be placed there at the top, as were my co workers.

It’s not a voluntary transfer. You washed. They are kicking you out of your current facility. Section (3) below that.

Look up OPM rules on what they consider a voluntary transfer or not.

Additionally consider appendix B. EUG as an up/down has both lvl 6 D2 and D3. Under h2 you are assigned to D2 and pay is reduced accordingly. BFI as a tower only does not have a D2 band according to appendix B. So the D2 washes get placed in the D3 band.

H2 doesn’t apply. It’s not a voluntary transfer, it’s involuntary. h3 is what applies.

Pay retention rules should keep you at your base, even at d2. Pay retention is covered by OPM rules, Google them

NEST movements are voluntary. Involuntary is like some of those N90 controllers in PHL, not a washout given a 2nd chance.

You don’t know what words mean, it doesn’t exclude training failure. You presumably tried your best. It didn’t work out. That means it’s not your fault. Fault means wrongdoing in government speak. If you dated a coworker, they dumped you, you stalked her (or him, it’s 2025) and they got a restraining order, based on your inappropriate conduct the agency could send you somewhere else. That’s fault. Not getting through training despite giving it your best shot is not fault, it’s presumed you did everything in your power to make it

So would you argue that an employee bears no fault in the unsuccessful end of a process of which they are an active and integral part?
