NEST TOL offer incorrect pay?

It’s not a voluntary transfer. You washed. They are kicking you out of your current facility. Section (3) below that.

Look up OPM rules on what they consider a voluntary transfer or not.
I would consider voluntary when you sign a TOL and say you will go there 😂😂

You’re being forced to sign it as a result of management action. It’s that or the streets. That’s not really voluntary is it? OPM defines management action as something non disciplinary in nature that causes you to have to make a choice or influences your choice

True, dumb it down to lowest common denominator. Airlines did the same thing-used to be ‘up or out’. Now it’s ’train to proficiency’

And you get to listen to them complain about being "shafted" since they are, apparently, involuntarily given a second chance at another facility?

If you do a quick search on Reddit, you'll see numerous reports of D2 Z flunkies getting moved to the top of the D2 pay band at their new facility. If there is no D2 pay band, then they would be placed at D3. And that roughly seems to be what I've heard over the years from trainees that were about to wash.

Honestly, sounds like the other two failures got an error in their favor. If I were one of those two flunkies, I wouldn't be spending that extra cash just yet.
 
H2 doesn’t apply. It’s not a voluntary transfer, it’s involuntary. h3 is what applies.

Pay retention rules should keep you at your base, even at d2. Pay retention is covered by OPM rules, Google them
Nobody ever keeps base pay. All pay adjustments work off basic pay.
 
Just wanted to follow up here with the official answer. It’s fairly tough to find and lies in appendix B. (Nice catch by Martna8447) Towers Only and Approach Controls Only level 7 and below do not pay a D2 level, only 8s and above. Only Up/Downs pay this band. Why pointsixtyfive and 123atc list a D2 payscale for these towers is effectively an error. Any developmental who washes out and selects a level 7 or below tower only will automatically jump to the top of the D3 band provided their pay exceeds that at the facility they washed out from. If the developmental selects an up down facility though and washed before reaching D3 they will go to the top of the D2 band as it is a used pay band in up down facilities. This does result in a permanent reduction in pay as you will never see the 6% raise up into the cpc band when you certify as you will never make the top of the D3 band, only the bottom. The only thing I know is that level 7 Tower only facilities DO have a D2 band
 
Idk how the progression would work for an academy grad but for prior experience they would start you off at D2
I know academy grads that were at the 7 that I was at years ago get to D3 once they got FD/CD/GC. Prior experience people that came to the 7 would start at D3 since the progression was was AG to D3 than to CPC... We didn't have a D1 or D2. That was years ago

Idk I have friends that went to a 7 Tower that definitely started at D2 🤷‍♂️.

Obviously getting FD/CD/GC would put you at D3 since you only have LC left.

Unless I'm reading appendix b of the contract wrong, a level 7 tower only should not have a d2 pay level

Well I'll have to ask my friends how it ended up because they had told me their FOL had said D2 or whatever. I started at D3 but was at a 5
