Hardships

Why do ppl only hardship to desirable locations? No one has a 500 lb grandpappy in Erie, PA in an iron lung who needs to be fed quaker oatmeal and have his diapers changed after blowouts!? All the sickest sick-ass-fools are marinating in vacay destinations u could win a package to on Drew Careys Price is Right (seen daily in ALL ATC break rooms 11est/8pst)? And we have ppl on here carrying water for this system. Whatsup w that?

Not only does this this mean that potentially 700 different and more deserving people could have left, but training at the facility they left could have been more easily accoMplished given they would have an extra Cpc. Blame the ncept all you want, but these shitheads, other than the legit hardships, did a tremendous amount of damage to others opportunities within the current placement system.

But at the same time, there are somehow 700 other people that deserve to transfer? Who are you to decide who "deserves" to move? I'm glad you're the expert on everyone's individual situation.

There are a lot of things we agreed to when taking employment, but that doesn't mean they are just or fair at all. That also doesn't mean that the FAA didn't outright lie to us when we were offered employment and told us that it was easy to move around, or that we would be able to pick a region at least, or that we would be D2 within 3 months so it would be okay if you went to a VHCOL area.

Maybe spend less time giving a fuck about what everyone else does with their lives?

Ive NEVER said they must work their forever. nor do I think all people who hardships are assholes. But 100 a year is insanity. I do not believe 3-5 years is unreasonable. and understand and respect longer can ben unbearable and does in fact happen. But I believe SOME not ALL of those facilities can be helped, and hardships have made it worse for SOME not ALL of them. The ripple effect nationally is also real given how many hardships there are.

My biggest complaint regarding hardships are the people, in my direct experience who file for them or who see them as they only way out are also the people who do little to nothing to actually help staffing, training, morale, and constantly shit on anything the faa or natca are supportive of. will shit on management one minute and then throw their coworker under the bus another. these are also people who are actively engaged in bringing people down just because they didnt realize they may have to spend some time somewhere. When you hardship at the same time as you ERR and turned down an ERR, blocking another from getting picked up, you are a special piece of shit.

these are the people who will shit all over ncept and the process and how its not fair and be then be the cause of fucking their co workers over and having to wait longer than they have to. you complain of your circumstances than dont see what a hypocrite you are.

I was not once told it was easy to move around. If you were told that, im sorry you didnt do your homework to realize it might be more difficult than you were told.

I think you need to look into a labor law or employment lawyer? Not sure. Either way you'll need to call around and see which one can and is willing to help you. Assuming you're hardship is legitimate there's no reason you can't fight to get it approved yourself if the union is not helping you push it over the hill and the agency is pushing back. As long as your ducks are in a row you should have no issue. That's my belief.

Seems that would be a very uphill battle since Article 99 was collectively bargained and the union has a significant say in whether you are approved or not. You'd be fighting both NATCA and the agency. Not realistic imo unless you have F you money! but uf you had that you prob wouldn't be stuck in your situation

Why are they telling you it’s denied? Chances are your paperwork isn’t in order. Hardships are easy to come by, you just have to be willing to lie

Have you exhausted all resources? Is it getting denied at the local level or the regional level? Is it only the agency that denies it? The hardship is collaboratively approved or denied. If the faa is against the hardship what is natca saying? If no one is supporting you then maybe your documentation isn’t in order to meet the requirement. Get feedback from your rep or go straight to your regional hardship rep.

A lawsuit should not be needed. The FAA or Natca does not asses the actual validity of the hardship. If a doctor says it is a medical hardship and you have the right paperwork it’s approved. And yes people try and say it’s bullshit but how many managers call the doctor? Cmon. Get your rep or the reginal rep to take care of it or get better paperwork.

Sorry I'm assuming this a bona fide hardship that they're choosing to simply not allow. If it's not legit then obviously don't sue
 
End up in a facility you don’t want to be in right out of the academy? The first week you get either you or your spouse to go to a doctor and complain about allergies, 3 months later again, 3 months later again, etc. do this until you check out. As CPC produce all evidence that you have been seeking treatment for regional allergies since you moved there and BOOM, time to enjoy your free transfer to P50 and D01 with all the other scammers. I’m not knocking it. If FAA just let you pick 3 regions or facilities you actually want to live or work at then the workforce wouldn’t have to scam the hardships, and the NCEPT page wouldn’t be full of complainers ever 3 months. Easy solution because my bet is majority of NCEPT are the younger work force that didn’t have a say in region where they currently work.

My ATM refused to agree that my hardship fell within the contract (which it did). I heard this from my facrep. After the timeframe that the ATM was given by the contract I asked her why my paperwork hadn't moved on. She told me she didnt deem it a true hardship even though I provided a written letter from the doctor. My ATM wanted more information. Per my Facrep she wanted to see power of attorney paperwork and shit like that.

Guess what. That'ts not the ATMs job. She never approved my paperwork but sent it to the next level as she has to per the contract. The region approved it instantly and did not ask me for a single piece of paperwork other than the original doctor's note. ATMs like to abuse their power and most of them suck.
